Azerbaijan moves to revise legislation on IDP status

Another case related to the re-regulation of IDP (internally displaced persons) status within the legislative framework is being introduced, APA reports.

The provision is reflected in the proposed amendments to the Law on the Status of Refugees and Internally Displaced Persons (Persons Displaced Within the Country), which were discussed today at a joint meeting of the Milli Majlis Committees on Labour and Social Policy and Human Rights.

Under the current legislation, an IDP loses this status when he or she returns to the former place of residence, is provided free of charge with another place of residence of a specified size in the same region instead of the previous residence, or is provided with housing at a level determined by a special state decision.

According to the draft law, a citizen will also lose IDP status if he or she refuses the above-mentioned housing options.

According to the transitional provision, IDPs who, before the entry into force of this law, were provided free of charge with another place of residence in the liberated territories instead of their previous place of residence will lose their IDP status from the date the law enters into force.

Under the new proposal, a person will be provided with another place of residence of a specified size in the region where he or she lived instead of the previous residence. Thus, the allocation of new housing by the state will serve to fully restore the citizens’ property rights.
