Azerbaijan establishes new norms for deductions from employee salaries related to alimony

A new rule has been established regarding deductions from an employee’s salary related to alimony, APA reports.

This is reflected in the amendments to the Labor Code, for which President Ilham Aliyev signed a decree.

According to the Labor Code, the total amount of all deductions withheld each time a salary is paid cannot exceed twenty percent of the employee’s salary, and in cases specified by the relevant legislation, fifty percent. When amounts are withheld from the salary based on multiple enforcement documents, in all cases, fifty percent of the employee’s salary must be retained.

The established limits do not apply to deductions from an employee’s salary in cases of serving corrective labor, as well as withholding of alimony, compensation for harm caused to health, compensation for damage caused to persons harmed due to the loss of the family breadwinner, and compensation for harm resulting from a crime.

According to the amendment, in these cases, the amount of deductions cannot exceed 70 percent of the employee’s salary. In other words, when serving corrective labor, as well as withholding of alimony, compensating for harm caused to health, compensating for damage caused to persons harmed due to the loss of the family breadwinner, and compensating for harm resulting from a crime, deductions cannot exceed 70 percent of the employee’s salary.
