Azerbaijan bans child abusers from serving as legal representatives in civil and criminal proceedings

A person accused of inflicting moral, physical, or material harm on the represented person through an act provided for by law may not be allowed to participate in civil proceedings as the legal representative of that person, APA reports.

This is reflected in the proposed amendment to the Civil Procedure Code, which was discussed at today's session of the Milli Majlis.

According to the proposed amendment to the Criminal Procedure Code, a person who is alleged to have caused moral, physical, or material damage to a victim, civil plaintiff, suspect or accused person, or civil defendant by an act provided for by law may not be admitted to participate in criminal proceedings as the legal representative of that person.

In order to protect the personal data of children who are participants in criminal proceedings, the Criminal Procedure Code stipulates that the consent required for the disclosure of information about the identity of minor suspects, accused persons, or victims must be only in written form. According to this article, consent is obtained from the children themselves and their legal representatives. The same approach is proposed for the Law "On Media".

The draft was put to a vote and adopted in the first reading.
