Azerbaijani court sustains claim of citizens of Switzerland regarding child adoption

APA reports that the closed hearings started in 2011, finally the court sustained the claim of foreigners.

The citizens of Switzerland Thuhufa Markar Jassim and Idroos Mohamed Markar wanted to adopt a child in Azerbaijan. Together with the representative of the State Committee for Family, Women and Children Problems they visited Childrenâ€™s Home #1 in Baku and chose a child. Following this, in line with the Azerbaijani legislation, they appealed to Nasimi district court.

Thuhufa Markar Jassim and Idroos Mohamed Markar were plaintiffs, Childrenâ€™s Home #1, the State Committee for Family, Women and Children Problems and Trusteeship Commission of Nasimi district executive power were interested party.

But the court rejected the claim. Nasimi district court passed a judgment on February 25, 2011. Though the foreigners appealed to Baku Appeals Court, they lost the case. The citizens of Switzerland appealed to Azerbaijani Supreme Court and won the case. Later Baku Appeals Court also annulled the decision of Nasimi district court.

Though Childrenâ€™s Home #1 is dissatisfied with the decision of the court, the child will be soon handed over to the citizens of Switzerland.
