The court upheld the convict’s complaint. The verdict of the Court of Appeal was annulled and the case is now to be considered anew.
Note that during the preliminary hearing at the Bakuy Court of Appeal, the convict’s attorney requested an investigation into the process. But the court rejected the request. Therefore, the attorney filed a cassation appeal to the Supreme Court against that verdict.

As a result of a series of anti-terrorist actions, citizens of the Republic of Azerbaijan suspected of committing the crime – Nasibov Namig Kamil oglu and Alakbarov Elnur Tahir oglu – were detained.
It was revealed that Namig Nasibov took part in fights in the areas under the control of PKK terrorist organization of the Syrian Arab Republic in August-September, 2014. After returning from the Syrian city Kobane, Namig Nasibov together with Elnur Alakbarov created “Yekbun”, an illegal PKK offshoot in Azerbaijan, and began to involve supporters in the organization.
On the behalf of the offshoot, Namig Nasibov and Elnur Alakbarov made calls through social networks for actions in Baku.
Under the verdict of the Baku Court on Grave Crimes, Elnur Alakbarov was sentenced to 15 years in jail and Namig Nasimov was sent to compulsory treatment. Alaknarov’s attorney Namiq Hajiyev filed a complaint of appeal against the verdict, demanding acquittal of the person he defends.
And the public prosecutor filed a protest of appeal against the verdict on Namiq Nasibov, another convict, demanding the cancellation of the verdict against him and his release. The protest is being considered in separate proceedings at the Baku Court of Appeal.
