Baku. Shahriyar Alizadeh – APA. The Baku Court on Graves on Wednesday resumed the hearing on the case of Taleh Baghirov, Fuad Gahramanli, and others.
During the hearing presided over by judge Alovsat Abbasov, Alibala Valiyev and Jabbar Jabbarov, who pleaded not guilty.
Valiyev said he saw policemen enter the yard after he finished the prayer. Asked how he knew they were policemen, Valiyev said they were wearing in black and had the word “police” written on their back. Valiyev added that he was not tortured before being taken to the Main Directorate for Combating Organized Crimes and that he was a relative of Abulfaz, the owner of the house, and that he used to stay in that house before too.
Alibala Valiyev told investigators during preliminary investigation that he considered himself partially guilty, saying he came to know Taleh better during Muharram, when Taleh would come to the mosque and give sermons. He developed closer friendship with Taleh when he began to visit Abulfaz’s house more frequently. On the day the incident took place, he visited the house again. At the time of the afternoon prayer, a sudden hue and cry erupted. Then gunfire began to be heard. He cut short the prayer and went out and found police coming at him. He surrendered right away and gave them the grenade that he had.
Jabbarov claimed that he was tortured during investigation, saying that he had been in prison before. He added that no one in the house had a gun at the time of the incident and that they had not shown any resistance.
Whereas, Jabbarov said in his testimony that he listened T. Baghirov in Haji Abulfaz’s house. He was at that house during the prayer and heard noise outside. When he went out, masked police officers entered the coutyard. He fired on the police. The police detained him adn other persons and disarmed them. The seized the gun from him.
Thereafter, the attorney Nemat Karimli said the clothes of the accused persons were changed in the Department to Combat Organized Crimes and made a petition on submission of those clothes and videos on leaving of the accused persons the car in the courtyard of Department to Combat Organized Crimes to the court.
Commenting on the petitions, the prosecutor Nasib Bayramov and Ramin Nagdaliyev requested to reject the first petition due to groundless and the lawyers to apply to the department and get a response.
The court satisfied the petitions.
The process will be resumed on August 18.
Taleh Bagirov is charged under paragraphs 120.2.1, 120.2.3, 120.2.4, 120.2.7, 120.2.12 of article 120 (premeditated murder), 29,120.2.1, 29,120.2.3, 29,120.2.4, 29,120.2.7, 29,120.2.12 29,120 of article 29,120(attempt to murder), under articles 228.3 (illegal purchase of firearms) and 228.4 (illegal possession of firearms). Taleh Bagirov was detained by law enforcement officials during a special operation in Nardaran settlement of Baku on 26 November. During the operation 60 people were detained. The criminal case of some of them were sent to the Sabunchu District Court.
Deputy chairman of Azerbaijan Popular Front Party (APFP) Fuad Gahramanli was arrested on December 8,2015.
He was brought to justice as a suspect under the Article 281.1 (public calls against the state) and 283.2 (incitement of national, racial, social or religious enmity and hatred by using violence) of the Criminal Code of Azerbaijan.
