Baku – APA. Chamber of the European Court of Human Rights has passed a preliminary decision on Tofig Yagublu’s petition. The court approved that paragraph #1 of article #5 (right to liberty and security of person) of the European Convention on Human Rights was violated.
ECtHR passed a decision on 20,000 euros for compensation of moral damage and 4,000 euros for others.
Tofig Yagublu was sentenced to pre-trial detention in February 2013. Then, Tofig Yagublu’s term of sentence was extended. The court hearing on Tofig Yagublu’s case was started in November, 2013 and he was sentenced to 5-year imprisonment in March, 2014.
The decision says that cassation appeal against Tofig Yagublu’s arrest is being considered by the Supreme Court.
