The court concluded that prior to the hearing, the detainees’ right to defense had been violated, indictment improperly compiled, and right to review proceeding materials violated. In order for these offences to be corrected, the criminal case was dismissed and handed over back to the prosecutor General’s Office which is in procedural charge of the preliminary investigation.
Furthermore, the court issued a separate verdict against Miri Baghirov, deputy head of the investigation department of the department of preliminary investigation into crimes of tax evasion under the Ministry of Taxes, for committing gross offences during the proceeding prior to the hearing.
