Ukrainian millionaire Oleg Krapivin, known in criminal circles by the nickname “Oleg Bakinski,” and Konstantin Kucher have faced the final court hearing in their criminal case over charges of hooliganism in Azerbaijan, APA reports.
The final session was held today at the Baku Court on Grave Crimes under the chairmanship of Judge Elnur Nuriyev. During the hearing, Konstantin Kucher delivered his final statement.
The verdict was then announced. According to the ruling, Oleq Krapivin was sentenced to 2 years and 6 months of imprisonment. However, Article 70 of the Criminal Code was applied in his case, meaning his sentence was deemed conditional with a 6-month probation period.
Konstantin Kucher was acquitted of the charge under Article 178.4 but was found guilty under Article 221.3 and sentenced to 2 years and 6 months in prison.
The court also ordered the lifting of the seizure on Kucher’s account at “GunayBank.”
Recall that public prosecutor Tural Yagubov requested that Konstantin Kucher be sentenced to 14 years in prison and Oleg Krapivin to 3 years.
Note that "Oleg Bakinsky" was detained by the police in Baku last year on charges of hooliganism against a Russian citizen. He was charged with a final charge under Articles 127.2.3 (Intentional infliction of less serious harm to health, committed in a generally dangerous manner or with hooligan intent) and 221.3 (Hooliganism committed with the use of weapons or objects used as weapons, accompanied by the use of force against the victim, or the destruction or damage of another person’s property) of the Criminal Code. The preventive measure of arrest chosen for him during the preliminary investigation was replaced with a preventive measure of house arrest during the trial.
Along with Oleg Bakinsky, Konstantin Antonovich Kucher, who served as Deputy Minister of Defense Industry of Ukraine for Aviation Affairs in 2010-2011, is also found guilty in the criminal case. He is charged under Articles 178.4 (fraud, especially when committed with causing large-scale damage) and 221.3 (hooliganism, committed with the use of weapons or objects used as weapons, accompanied by the use of force against the victim, or the destruction or damage of another person's property) of the Criminal Code.
The victims are "Aviazapchast" OJSC, "Promyshlennye Postavki Kazakhstan" LLC, and Zakharenkov Valery Nikolayevich.
