European Court of Human Rights releases final decision on Eynulla Fatullayev’s appeal against Azerbaijan

APA reports quoting an official website of ECHR, the decision released on October 4, 2010 is the final one.

According to the “Final” decision, the ECHR’s decision on Eynulla Fatullayev released on April 22 is remains in force and that decision has been posted on the site again. The decision says that the state shall secure the applicant’s immediate release and pay EUR 28,000 in respect of pecuniary damage.

Note that Eynulla Fatullayev was arrested on April 20, 2007 and later he was sentenced to eight-and-a-half-year imprisonment for threat of terrorism, incitement to ethnic hostility and tax avoidance. 0.223 g heroin was found on Eynulla Fatullayev in jail #12 on December 30, 2009. As a result of biological-chemical examination, heroin and a psychotropic substance were found in Fatullayev’s blood and urine examples. He faced charges under Article 234 (illegal manufacturing, purchase, storage, transportation, transfer or selling of narcotics, psychotropic substances) of the Criminal Code and sentenced to two-and-a-half-year imprisonment by Garadagh district court.
