Chingiz Asgarov: â€œDecision on receipt or non-receipt of complaint on Eynulla Fatullayev at the Grand Chamberâ€™s execution will be known in October-Novemberâ€ - EXCLUSIVE

Asgarov said that firstly, appropriate committee of the Grand Chamber should be established for it: â€œGrand Chamberâ€™s meeting was held on September 8. A staff including 5 judges should review the issue on establishment of the committee. There is another period after this as well. In the next period they should make a decision on whether to review this complaint at the Grand Chamber or not. Lately, Azerbaijani state filed a complaint to the Grand Chamber on another issue. At that time, we have received a response after 4 months. We have given a complaint related to Eynulla Fatullayev in July, this year. There will be made a decision in October-November on whether to receive it at the execution or not. If they receive it, then this issue will be reviewed within a yearâ€.

Asgarov took a stance also on Fatullayevâ€™s wish to run for the parliament at the parliamentary elections: â€œDecision of the European Court of Human Rights has not come into force yet. Fatullayevâ€™s imprisonment has not been taken yet. Now Central Election Commission should make a decision on whether a prisoner may participate in the elections or notâ€.

Asgarov noted that there were nearly 100 applications in the execution of the European Court of Human Rights.

Note that, on April 22 of this year, the European Court of Human Rights considered the appeal of imprisoned journalist Eynulla Fatullayev against Azerbaijan. According to the judgment, the European Court demanded immediate release of the journalist grounding that the articles of the Convention on Human Rights and Fundamental Freedoms were violated during the consideration of the criminal cases on Eynulla Fatullayev. The Azerbaijani government was dissatisfied with the judgment of the European Court and appealed to the Grand Chamber.
