Department chief of the Presidentâ€™s Office: â€œJudges donâ€™t have responsibility for the decisions annulled the European Courtâ€

Mahbube Gasimbeyliâ€“APA. â€œThe judges donâ€™t have responsibility for the decisions annulled by the European Courtâ€, said Fuad Alasgarov, Chief of the Department for Law-Enforcement Bodies of the Presidentâ€™s Office, APA reports. He said annulment of the decisions didnâ€™t mean that the judges had to be punished certainly. â€œIn this case there will not be unpunished judge in the world. The decision-making process in the European Court follows by the execution proceedings, which are carried out by the concrete measures and at the same time it can be accompanied by the appropriate changes in the legislation. European Courtâ€™s conclusion on the law-breaking cases follows by the appropriate proceedings in Azerbaijan. The Supreme Court reviews the case and approves law-breaking identified by the European Court and annuls the courtâ€™s decision on that case. After that, the case is sent to the certain court instance for the investigation of law-breaking factâ€.
