 European Court of Human Rights rejects 8 Azerbaijani journalists’ appeal

Basing on the article 35 of the Convention, the court has rejected the appeal, because the complainants didn’t observe the rule of confidentiality of truce agreement on the eve of correspondences in this respect.

 

On June 12, 2017, journalists – Ganimat Zahidov, Shahvalad Namazov (Chobanoghlu), Rauf Abbasov (Arifoghlu), Azer Abbasov (Aykhan), Elshad Mammadov, Zabil Najizadeh (Mugabiloghlu), Etibar Aghayev (Seyidagha) and Mehman Aliyev addressed the Baku Mayor’s Office to hold a rally in the city. But the Mayor’s Office offered another place. The journalists, who didn’t agree with this decision, gathered in Sabir park and attempted to hold a rally. But the police prevented this and four out of them were taken to the police office. They were released after having been detained for 2 hours.

 

Following this, journalists appealed to the court. All courts rejected their appeals. The complaint filed to the European Court of Human Rights said that the police treated the protesters rudely and courts conducted wrong investigations.

 

European Court of Human Rights has started communication with the parties regarding the complaint. The government has proposed to the plaintiffs to sign truce agreement in June 2011. A number of newspapers published articles about the terms of truce agreement and positions of plaintiffs and their lawyers in this regard in August, 2011.

 

Basing on the violation of the agreement by the plaintiffs, the government appealed to the European Court of Human Rights for rejection of the complaint. The court rejected the complaint basing on the fact that the plaintiffs had violated rules on confidentiality of truce agreement in the period of correspondence under the Article 35 of the Convention.
