Department head: Retaliation against a person reporting corruption violations entails criminal liability

The legislation provides state protection for individuals who report corruption violations, Aynur Osmanova, Head of the Legal Support and Human Rights Department of the Prosecutor General’s Office, said during a live broadcast on the Prosecutor General’s Office Instagram page, APA reports.

She noted that it is prohibited to take any retaliatory measures against such individuals because of the information they provide.

“If a person who reports relevant corruption violations believes that their dismissal or disciplinary punishment is connected to the information they provided, the burden of proving otherwise lies with the employer. All issues related to the protection of persons reporting corruption violations are regulated by legislation. Criminal liability has also been established for such cases,” she said.

It was noted that dismissing or threatening a person in retaliation for reporting corruption offenses is regulated by law, and such individuals are protected by amendments made to the Labor Code.

“Applying pressure on such persons or causing them material damage constitutes an administrative offense. In aggravating circumstances, criminal liability is envisaged,” it was stated.
