Baku Prosecutor’s Office and Baku Main Police Office issue joint statement on imprisoned journalist Eynulla Fatullayev

The statement says that on December 29, 2009, heroin was found on Fatullayev Eynulla Emin and Shamsiyev Shahin Ibad in jail #12 of Justice Ministry’s Penitentiary Service and Garadagh district police office launched criminal case on articles 234.1 (illegal purchase or storage without a purpose of selling of narcotics or psychotropic substances in a quantity (amount) exceeding necessary for personal consumption) of the Criminal Code. The fact was investigated, witnesses gave testimonies, the employees of the jail, prisoners were interrogated. They said narcotic drugs were found on Fatullayev and Shamsiyev.
Basing on the evidence, Eynulla Fatullayev faced charge under article 234.1 of the Criminal Code on December 31.
As 0.081g heroin found on Shahin Shamsiyev was not in a quantity (amount) exceeding necessary for personal consumption, he did not face charges.
Though during the interrogation Eynulla Fatullayev confessed that narcotic had been found in his shoe and jacket in the presence of witnesses, he said he was not user of drugs.
The witnesses once more confirmed that narcotic had been found on Eynulla Fatullayev.
According to the chemical examination, the substance found on Eynulla Fatullayev and Shahin Shamsiyev is primitive heroin and there are traces of heroin on Eynulla Fatullayev’s jacket and shoe.
According to the biological, chemical examination, diacetylmorphine (heroin), amphetamine, flunitrazepam were found in the blood and urine samples taken from Eynulla Fatullayev, diacetylmorphine, dihydromorphine, amphetamine and flunitrazepam were found in the blood and urine samples taken from Shahin Shamsiyev.
According to narcological examination, Eynulla Fatullayev had used diacetylmorphine (heroin), amphetamine and benzodiazepine, but he does not need compulsory treatment as he did not suffer from drug addiction during the examination.
It is noted that the requirements of the European Convention on Human Rights and Fundamental Freedoms and Criminal Procedure Law has been fully observed during the initial investigation.
The investigation of the criminal case is about to end, the public will be informed about the results.
