Hungary officially responds to EU legal challenges

Baku-APA. The Hungarian government on Friday officially responded to the European Union’s (EU) legal charges to the country’s controversial legislation, a government spokesman announced, APA reports quoting Xinhua.

The European Commission in January launched legal action against Hungary, saying its new legislation, which came into force on Jan. 1 under Hungary’s new constitution, violates EU treaties by undermining the independence of the country’s central bank and data protection authorities and by the measures affecting its judiciary.

The commission also questioned the country’s new media laws. It gave the Hungarian government one month to respond to the concerns.

The official response addressed all of these issues, the government spokesman said, adding that the written response followed multiple oral consultations with EU officials.

The European Commission was critical of Hungarian laws enabling the government to have a hand in the dismissal of central bank governors and Monetary Council members and to pad the Monetary Council by appointing additional members.

Regarding the judiciary, the commission was particularly critical of a law reducing the mandatory retirement age of judges from 70 to 62. This move has affected 274 judges including Supreme Court Justices, who are being forced to retire, making way for new appointees by the current administration.

The government established a cabinet-run National Agency for Data Protection and dismissed parliament’s commissioner for data protection in the middle of his term, casting serious doubts on the independence of the data protection authority.

Although the EU voiced concerns over a new media law, it did not officially charge Hungary with breach of treaty in this respect. But Hungary did respond to these concerns in its official letter.

The official response marked the end of the first procedural phase following the charges. The commission will now decide whether to move forward with the proceedings. If so, it will send a letter of warning to the government.
