Azerbaijan drafts new law on public services to boost transparency and service quality

A draft law "On Public Services" has been prepared, APA reports.

The draft law was discussed at today's meeting of the Committee for Law Policy and State-Building of the Milli Majlis (Azerbaijani Parliament).

The draft law defines the organizational, legal, and economic foundations of activities in the field of public services and will also regulate relations in the provision of public services.

The draft law introduces definitions related to public service, the place where public services are provided, unified service centers, and legislation concerning the design of public services. Public service is defined as a set of actions performed by service providers in connection with the exercise of their powers, which result in a certain legal outcome or the provision of necessary information to the service user. The place of public service provision refers to the location where the service provider delivers the service—either within their administrative building or outside it, including locations for mobile (outreach) services, as well as unified service centers or information systems where public services are provided. A unified service center is a place where public services are delivered jointly by service providers and private organizations. The design of public services is described as a set of conceptual and functional solutions that identify the needs and requirements in the formation of public services.

The State Register of Public Services (hereinafter referred to as SRPS) is a unified information system that contains data on public services. In addition, the draft law specifically defines the scope of service users, as well as their rights and responsibilities.

- In order to reduce corruption risks in the provision of public services, the draft law introduces the principle of queuing, ensuring that applications for public services are processed in sequence, except in cases stipulated by law.

With the adoption of the draft law, requirements for the formation of public services will be established. According to the draft, a public service may only be provided after it is entered into the State Register of Public Services (SRPS).

The proposed draft states that the outcome of providing a public service may be delivered in the form of an administrative act, legally binding or technical documents in electronic or paper format, or by providing information as part of informational electronic services.

An important aspect reflected in the draft is the establishment of a mechanism for monitoring the quality of public services. The "ASAN Service Index" evaluation mechanism will be further improved, and its results will serve as a basis for overseeing the quality of public services.
