Azerbaijan legalizes construction of paid motor roads

Baku. KamalÉ™ Guliyeva – APA. The issue on construction of paid motor roads in Azerbaijan was legalized. According to APA, the amendments and annexes in the Law on “Motor Roads” were discussed at today’s meeting of Milli Majlis. Chairman of Economic Policy Committee Ziyad Samadzadeh informed about the amendments. According to him, the draft law was seriously discussed at the Committee with the participation of experts of the Ministry of Transport.

MP Ali Masimli said that the most of paid roads are in Croatia and Turkey: “The paid roads must absolutely have alternative. I appreciate inclusion of this provision in the draft law. The payment for these roads in the US is at the range from $0.5 to $15. IN Azerbaijan, these prices must be lower”.

MP Faraj Guliyev said that in the South Caucasus, most of roads are constructed in Azerbaijan but after a period, these roads are destroyed and canalization and other infrastructure is constructed.

According to project, paid motor roads can be constructed in the country to modernize and enlarge motor roads network, provide services to motor roads users, ensure high speed regime and security requirements. The paid motor roads meeting the standards can be constructed on the basis of republican and local motor roads under the state ownership, as well private motor roads under the common use. According top project, the payment can be imposed on whole road and its any part, including bridges and other road structures.

The payment on these roads will be determined by relevant Executive Power.

A decision on usage of State-owned republican or local motors roads as a paid road, as well as construction of new paid roads is passed by the appropriate executive authority.

A decision on usage of municipal or private roads as a paid road is passed by the owner of the road agreeing with the executive authority. The application about agreement is reviewed within 30 days.

Decision on usage of the current or to-be-constructed roads as a paid road must be spread on media 30 days before the opening of the road. Special vehicles participating in transportations related to maintaining public order, elimination of emergency situations, as well as the cars belonging to police, emergency and restoration, utilities, emergency medical services are free from fare on paid roads. Owners of private roads have a right to apply concessions for some types of users and vehicles from different categories.

The usage of paid road may be suspended in case if there occur obstacles for alternative free-of-charge roads, if there declared military or state of emergency, as well as if there occur natural or man-made emergency situations. Suspension period must not exceed 6 months.

Draft law was adopted as a result of the voting at the meeting.
