Azerbaijani Devechi region police office twice rejected launching criminal case on Tavakkul Ismayilov accused of killing Majidova sisters

Resident of Devechi region, Dag Biliji village Badal Dashdiyev accused law enforcement bodies for not finding his missing daughter Dilafruz Dashdiyeva since May 17, 2005. He told APA’s local bureau that resident of Galagah village his requests to Devechi region police office and prosecutor’s office regarding his daughter Dilafruz, who was kidnapped by Tavakkul Ismayilov, were inefficient. Dashdiyev presented some official documents to APA to prove it. There were invoices about sending and getting the application to Devechi’s law enforcement bodies and different state bodies, officials’ correspondences and answers among them. The documents show that informed the local police, when he knew about his daughter’s kidnapping by Ismayilov.
We present the correspondences of Devechi’s law enforcement bodies without comments: former prosecutor of Devechi region Sabir Aliyev writes in his letter #06C-06 to police chief Nizami Sadigov on February 3, 2006:
“I annul the decision dated 11.06.2005 on rejecting to launch the criminal case on the material basing on the appeal of Huru Dashdiyeva (Badal Dashdiyev’s wife), as it is groundless and return it to you for additional investigation. The application of Badal Dashdiyev sent from Azerbaijani General Prosecutor’s Office and the documents gathered regarding the application are subjoined to the material and sent to you for detailed and objective investigation. I ask you to inform the appealer about the results of the investigation.”
Mammad Jabbarov, official of Azerbaijan Republic General Prosecutor’s Office stated in his response letter number 05/32, 01.03.2007.
“Your application received by Azerbaijan Republic President’s Office was examined and sent to Devechi Prosecutor’s Office for taking proper measures on it. Devechi Prosecutor’s Office will reply to you,” he said.
The response letter number 22-07 Devechi Prosecutor Sabir Aliyev sent to Badal Dashdiyev in 15.05.2007 says: “The region prosecutor’s office considered your application sent by Azerbaijan Prosecutor’s Office on region police department’s not examining appeals on missing till now and Galagah resident Ismayilov Tavakkul’s kidnapping your daughter Dilafruz Dashdiyeva and promising her marriage. The material gathered in investigation group of region police department on it was examined and decision on rejecting launching criminal case on the results of investigation was annulled and all the materials were sent to region police department for being investigated additionally”.
The decision adopted by Devechi Prosecutor Sabir Aliyev he addressed to Huru Dashdiyeva on May 5, 2007 and materials gathered by Devechi police station’s inspection group clarifies everything.
“Dag Biliji resident of Devechi region Dashdiyev Badal appealed on Galagah resident Ismayilov Tavakkul’s kidnapping his daughter Dilafruz Dashdiyeva and promising her marriage and not examining appeals in region police department on missing till now, not taking measures on the search of the girl. The material gathered in the investigating group of region police department on Dashdiyev’s spouse Huru’s appeal 01.06.2005 was investigated by my order.
Region police department’s investigative group investigator Joshgun Mutellimov led the investigation and criminal case was rejected under 11.06.2005 decision and article 29.1.2 of Azerbaijan Republic. As the decision was groundless, I rejected it on 03.02.2006 and instructed for additional examination. After the reexamination, it was decided to reject launching any criminal case on 02.03.2006 with the same ground. It was found out during the investigation that the previous investigation was not thoroughly held, instructions of the region’s prosecutor’s office were not fully implemented. The gathered materials show that Dialfruz Dashdiyeva left her house for Tevekkul Ismayilov with purpose of marrying him. The investigation did not make it more precise whether or not Dashdiyeva wenet with Tevekkul Ismayilov. Therefore, the material should be reexamined as the investigator’s 02.03.2006 decision on rejecting institution of a criminal case is groundless. During the repeated investigation, the details shown in the complaint of B.Dahsdiyev should be investigated thoroughly and objectively, Tevekkul Ismayilov and his relatives should be interrogated, necessary measures should be taken to find whereabouts of Dashidyeva and conclude a decision on this basis.”
Badal Dashdiyev told APA’s local bureau that Tevekkul Ismayilov named the persons patronizing him and announced they are for not launching a criminal case. However, taking into account that Republic Prosecutor’s Serious Crimes Investigation Department interrogated Tevekkul Ismayilov, who is suspected in the murder 14-year-old and 8-year-old Naile and Reyhane Majidova sisters and throwing them into Samur-Absheron channel on August 6, this year, for several hours, it is not expedient to publicize what he said.
Devechi region, Galagah village resident Tevekkul Ismayilov kidnapped Dilafruz Dashdiyeva on May 17, 2005. The girl disappeared some days later. Tevekkul Ismayilov refused did not answer to the girl’s family members’ question on whereabouts of their daughter. He only said the girl run away and did not where. Though Dialfrus Dashdiyeva’s father Badal Dashdiyev, who did not believe that, appealed to law-enforcement bodies, no investigation was carried out. Later on village resident Rahim Hidayetov found Dialfruz’s clothes in the nearby forest and handed to her family. Following this, Rahim Hidayetov disappeared. His body was found in reedy place while searching for missing Naile and Reyhane Majidova sisters on August 12 this year. /APA/
