Chairman of the Supreme Court: “Judges mustn’t be afraid of making independent decisionâ€
Rzayev spoke about discrimination of complaints submitted to the plenum of the Supreme Court: “Some so-called lawyers form an opinion that, Chairman of the Supreme Court puts to the discussion at the plenary meeting the case that he wants. It is wrong. Repealed cases at European Court of Human Rights, cases about the violations of constitutional rights of the Constitutional Court and new cases are being discussed at the plenary meeting of the Supreme Court. We cannot put to discussion any issue without these casesâ€.
Ramiz Rzayev called on the media to pay attention to the activity of the Supreme Court.
“We are an open body, ask questions, write and criticize us. But write the truth. We see false articles, we are accused of grave crimes. We have enough legal grounds to put an end to this. If a judge is accused of a grave crime, we can hold these persons accountable. Some may be disappointed, may criticize, but one is responsible for accusing someone of grave crime,†he said.
Ramiz Rzayev said the reports that the decisions of the European Court were not executed were wrong.
“It is impossible not to execute the decisions of the European Court. The Ministry of Finance pays the compensation determined by the European Court,†he said.
Chairman of the Supreme Court said there used to be some problems concerning the execution of the local courts.
“This is in the competence of the Justice Ministry, the ministry appealed to Prime minister in connection with this. After that a serious change happened, a great part of the unexecuted decisions were executed in a short time. Now the issue is under serious control and we will achieve complete execution of the decisions. The problematic issue is only the execution of the decisions on the removal of IDPs from the places they live,†he said.
