Azerbaijan expected to replace pre-trial detention with large bail

Baku. Mubariz Aslanov – APA. Maximum restriction of the pre-trial detention, in most cases its replacement with large bail can be discussed in Azerbaijan.

 

The Azerbaijani Parliament told APA that the relevant annexes and amendments are expected to be made to the Criminal Code and Code of Criminal Procedure. The amendments are based on the experiences of the US and European countries. If the draft law becomes effective, in the majority of criminal cases, the suspect will be released on large bail or the property equal to that amount will be bailed after the suspect gives written undertaking not to leave the place, that person’s pre-trial investigation will be continued as usual and the sentenced person will be sent to prison only after court’s verdict.

 

The aim is to increase efficiency in this field and bring more transparency to the recent problems revealed in the pre-trial period. With the application of new rules in the future, the pre-trial detention can be cancelled. The amount of bail and other issues will be specified when the draft law is put up for discussion. The document will be likely discussed at the parliament’s committee on legal policy and state-building this year.

 

According to the current legislation, pre-trial restrictions include “written undertaking not to leave the place”, “bail”, “house arrest” and “pre-trial detention”.
