European Court of Human Rights to announce next decision on Azerbaijan

Baku. Victoria Dementieva – APA. On October 14, the European Court of Human Rights will announce its next decision on Azerbaijan. It is expected to make decision in favor of applicant in the case Zemfira Safarova vs Azerbaijan, APA reports.

The applicant, Ms Zemfira Safarova, is an Azerbaijani national, who was born in 1960 and lives in Baku. The applicant was an owner of non-residential premises (“the Premises”) with an area of 350 square metres situated in Baku. The applicant’s ownership rights were registered in official records by an ownership certificate delivered on 17 July 1998. However, the Premises had been occupied by the Police Station no. 17 of the Narimanov District Police Department (“the Police Station”) since 1993. On 3 July 2003 the Narimanov District Court held that the applicant was the lawful owner of the Premises on the basis of the ownership certificate of 17 July 1998 and that there was no legal basis for installation of the Police Station in that place, but the court’s decision was not fulfilled. The applicant complained to ECHR under Articles 6 and 13 of the Convention about the continued non-enforcement of the judgment of 3 July 2003. The applicant further complained under Article 1 of Protocol No. 1 to the Convention about the violation of her right to peaceful enjoyment of possessions as a result of non-enforcement of the judgment of 3 July 2003.
