Opening the Plenum meeting, Chairman of the Constitutional Court Farhad Abdullayev introduced the court staff and the secretary.
The reporting judge, Sona Salmanova, noted that the Central Election Commission (CEC) has decided that the protocol on the polling results of the repeat parliamentary election held in Aghdash Constituency No.90 on June 29 be submitted to the Constitutional Court for the election results to be confirmed. She added that the submitted documents have been reviewed by the Constitutional Court.
“The protocol submitted by the CEC was signed by all of the 18 voting-eligible members of the CEC. The Supreme Court received 4 complaints, the decisions of courts of appeal about three complaints were upheld, and one decision of a court of appeal was cancelled. The prosecutor’s office received one complaint, which was sent to the CEC for consideration,” she said.
CEC Chairman Mazahir Panahov said they have registered seven MP candidates in Aghdash Constituency No.90.
“Four PACE observers were monitoring the process in the constituency. There were 743 registered observers. The PACE observers noted that the election was transparent and well-organized. The voter turnout was 57.9%. The initial results of the election were announced the same night. Candidate from the ruling New Azerbaijan Party Javid Osmanov gained 85.6% votes. The CEC received a total of 7 appeals, two of them with a delay. We received no appeal from observers. No appeal was made to courts as well regarding the elections. Under the Election Code, the CEC shall complete the process to examine and finalize the results of elections at the latest 20 days after the election day. However, in this case, we saw no need to wait for 20 days. On June 29, a decision was adopted to submit the Constituency election commission’s Protocol and attached documents to the Constitutional Court for approval of the protocol on general results of the voting, examination and approval of the results of the election. I think that the Constitutional Court can approve the document submitted by the CEC on the results of the election,” he said.
Later on, judges of the Constitutional Court addressed some questions to Panahov. He that during the registration of the candidates Ilgar Mammadov’s (chairman of REAL Movement) authorized representative returned an empty signature sheet blank.
Then the judges announced a break. After consultation, Chairman of the Constitutional Court Farhad Abdullayev read out the decision of the Plenum of the Constitutional Court. According to the decision, the Constitutional Court approved the results of the repeat parliamentary election in Aghdash Constituency No.90. Thus, under the decision of the Constitutional Court, the MP status of Osmanov who was elected as a member of parliament on Aghdash Constituency No.90 was approved in accordance with the final protocol of the CEC.

On June 29, a decision was adopted to submit the Constituency Election Commission’s Protocol and attached documents to the Constitutional Court for confirmation of the protocol on general results of the June 18 repeat parliamentary election in Aghdash Constituency No.90, examination and confirmation of the results of the election. According to the final protocol of the CEC, candidate form the New Azerbaijan Party Javid Osmanov (with 19,674 votes – 85,6%) was elected an MP in the parliamentary election in Aghdash Constituency No.90.
