Justice Minister Fikrat Mammadov: â€œMost consider the European Court of Human Rights the last resortâ€

Azerbaijani Justice Minister Fikrat Mammadov also addressed the High Level Conference on the Future of the European Court of Human Rights in Interlaken at the initiative of the Swiss Chairmanship of the Committee of Ministers of the Council of Europe. He appreciated the efforts of the Council of Europe and Swiss government to organize the conference devoted to the urgent issue.
â€œAs the saying goes, human rights are main values allowing us to consider ourselves mankind. The adoption of the European Convention on Human Rights and establishment of the European Court of Human rights in 1950 was a great step in the formation of the system of human rights protection. Most consider the European Court of Human Rights the last resort. But we also understand that this court is not at all considered the fourth instance for the national judicial systems, its work is based on the principle of solidarity. They say â€œThe European Court has become a victim of its own successâ€. This system has received so many complaints that it caused obstacles in the adoption of the decisions,â€ he said.

Fikrat Mammadov said Protocol 14 would give a serious impetus to the process.
â€œBut as the abovementioned protocol will not be able to eliminate the problem of imbalance between the received and already considered complaints, during this conference we express our support for the Declaration reflecting emergency measures on the European and national levels. We admit the improvement of the mechanisms of filtration, succession in the application of the precedent law, establishment of the institute for passing consultative judgments to the questionnaires of the national courts, improvement of the internal structure and working methods of the European Court of Human Rights. Moreover, we consider that the usage of only two official languages in making complaints, their compilation in the special form, application of taxes system in making complaints, language trainings for judges if needed, usage of opportunities of local judges in the field of registration may be reviewed,â€ he said.
