Court passes decision on inspector for special cases of Baku Main Police Office investigating case of Iranian citizen

Baku. Hafiz Heydarov – APA. Under the decision of the court, the criminal case launched on the Iranian citizen accused of swindling in Azerbaijan was sent back to the initial investigation. Decision was made on the inspector investigating the case, APA reports. Court of Grave Crimes has today held a hearing on the case of Iranian citizen Roohihir Mohsen accused of swindling. Mayil Bayramov presided over the hearing. The petitions filed by Roohihir Mohsen’s lawyer Natig Mustafayev was considered at the hearing. Only two of the petitions were granted. The court passed a decision to send back the criminal case to the initial investigation and a decision on Ilyas Karimov, inspector for special cases of Baku Main Police Office. The other petitions were rejected.

In the previous hearing, the lawyer filed petitions and asked to lift the arrest of Mohsen, pass a decision in connection with the inspector investigating the case, launch criminal case on the false witnesses and send back the criminal case to the initial investigation.

Mustafayev said they protested against sending the criminal case to Baku Main Police Office again.

According to indictment, Mohsen swindled more than ten traders at the Bina trade center misappropriating their one million AZN. The Iranian citizen received money from them promising to bring faience dishware produced in Iran, but didn’t keep his words.

The Court of Grave Crimes sentenced Mohsen to 8 years of imprisonment charging him under article 178.3.2 (swindle with causing damage in the large size) of the Criminal Code of the Republic of Azerbaijan. Baku Appeal Court held a hearing on his appeal and Judge Etibar Nabiyev presided the hearing. The Appeal Court concluded that first instance court violated law during the investigation and passed decision to return the case to the Court of Grave Crimes for reviewing it repeatedly beginning from the preparatory session.

The Court of Grave Crimes reviewed the case again and reduced Mohsen’s sentence to 7 years of imprisonment.

Baku Appeal Court held next hearing on the Mohsen’s appeal at the court session presided by Judge Rasul Safarov. The appeal court annulled the decision passed by the Court of Grave Crimes and sent the case back to the first instance court.
