Restrictions on election of prosecutor general lifted

According to APA, amendments to the law on prosecutorâ€™s office, service in the prosecution and labor pensions signed by President Ilham Aliyev on August 6, 2009 were already included in the parliamentâ€™s autumn session plan. According to the amendments proposed by the head of state the article â€œSame person canâ€™t be elected for more than two terms to the posts of Prosecutor General, military prosecutor of the republic of Azerbaijan and prosecutor of Nakhchivan Autonomous Republicâ€ was dropped from Part 2 of Article 16 of the law on prosecutorâ€™s office.

The existent version of Article 16 is that: â€œSame person canâ€™t be elected for more than two terms to the posts of Prosecutor General, military prosecutor of the republic of Azerbaijan and prosecutor of Nakhchivan Autonomous Republicâ€.

The proposed variant is: â€œto edit the second part of article 16 as follows:

-District and specialized prosecutors, cannot appointed to the same post more than twice.â€

As seen, in the proposed variant the sentence â€œOne and the same person can not be appointed Prosecutor General of Azerbaijan Republic, Military Prosecutor of Azerbaijan Republic, Prosecutor of Nakhchivan Autonomous Republic, Military Prosecutor of Nakhchivan Autonomous Republicâ€ has been removed and this means the elimination of the restriction.

Member of the parliamentâ€™s committee on legal policy and statehood Gudrat Hasanguliyev also proposed in the spring session to eliminate the restriction imposed on the appointment of Prosecutor General, Military Prosecutor, Prosecutor and Military Prosecutor of Nakhchivan Autonomous Republic. The parliamentarian told APA that his proposal had been taken into consideration in the bill sent to the parliament with the presidentâ€™s signature.
â€œThe document sent by the president covers not only the restriction imposed on the appointment of prosecutor general, but also other issues. This document is more perfect,â€ he said.

Head of the parliamentâ€™s office Safa Mirzayev has recently told journalists that the parliament has not received a document on eliminating the restriction imposed on the appointment of prosecutor general.
