Company manager arrested for falsification of Azerbaijani Supreme Courtâ€™s decision

On July 24, 2008, Turkish citizen Hasan Tarim Yakup was sentenced by Ganja Appeal Court for 8 years of imprisonment under article 263.3 of the Criminal Code of Azerbaijan. The decision of appeal court was kept in force by the decision of Supreme Courtâ€™s Panel of Judges on Criminal Cases. The copy of the decision was sent to the penitentiary where he served sentence. The penitentiary service informed the Panel of Judges on August 24, 2009 that the court decision about Hasan Tarim Yakup was changed by the decision of Panel of Judges on July 17, 2009 and reduced to 3 years of imprisonment.

The chief of penitentiary was immediately informed that the Supreme Court didnâ€™t change the decision of Ganja Appeal Court sentencing Yakup for 8 years and the decision submitted later on July 17, 2009 was false. According to the report, Hasan Tarim Yakup was not released from the penitentiary.

The false document was investigated by the Supreme Court and sent to the Prosecutor Generalâ€™s Office on August 25, 2009. On August 26, Prosecutor General passed a decision to launch criminal case on the fact of falsification on Article 320.1 of the Criminal Code. Department for Grave Crimes was commissioned to carry out the investigation.

The initial investigation found out that Executive Director of AzPak Kompanen company Kanan Sharifov falsified the judgment of the Supreme Court passed on June 9, 2009, he wrote that the sentence of Hasan Tarim Yakup was commuted to three-year sentence. Kanan Sharifov was held accountable and arrested.

Supreme Court refuted the reports written in the Yeni Musavat newspaper that serious inspections were carried out in the Supreme Court.
â€œAs stated in the Constitution of Azerbaijan Republic, courts are branches of the government, they act independently within their power and their activity can not be inspected by any executive body.â€
