Azerbaijan modifying conditions for selection of pretrial detention type

Azerbaijan is modifying the conditions for the selection of a type of pretrial detention.
 
 
In this respect, the Azerbaijani president’s proposal on modifying Article 155.3 of the Code of Criminal Procedure has been discussed at the parliament’s meeting, APA reported.
 
 
According to the amended article, pretrial detention will be applied against:
 
 
- a person found guilty of committing the crime punishable by more than 2 years in prison, in order to prevent the act mentioned in Article 155.1-155.1.3;
 
 
- a person found guilty of committing the crime punishable by up to 2 years in prison, in order to prevent the person from hiding from the authority conducting the criminal procedure;
 
 
- a person who has violated the terms of other previously determined pre-trial detention or to a person sentenced to imprisonment in order to ensure the execution of the court decision.
 
 
The current version of the Article reads as follows:
 
 
“Detention and alternative pre-trial detention shall only be applied to the following accused:
 
 
– a person charged with committing an offense who can be sentenced for more than 2 (two) years of imprisonment;
 
 
– a person charged with committing an offense who can be sentenced for up to 2 (two) years of imprisonment for the prevention of acts provided for in Articles 155.1.1 and 155.1.3 of this Code.”
 
 
The bill was put to the vote and approved.
