Baku – APA. Head of Khojasan village municipality of Binagadi district of Baku has been arrested, press service of General Prosecutor’s Office told APA. The criminal case was investigated in the Department to Combat Corruption under Prosecutor General. The case concerned head of Khojasan village municipality of Binagadi district of Baku Zefer Masimov. Masimov abused his power, passed an illegal decision on the state land plot damaging a legal entity’s interests and misappropriated a great deal of property.

The investigation found out that Masimov was to discuss at the municipal meeting the application of Gasimova Esmira Nazim for allotting land plot to build a house, but did not do it. Violating Article 6 of the Land Code and Article 6 of the Law on Land Reforms, having no authority to pass a decision on using, lending state land beyond 56.25 ha area owned by Khojasan municipality, Masimov passed a decision #31/27 on November 23, 2007, to transfer 400 sq m area to the ownership of Esmira Gasimova. But in fact the land plot was not given to Gasimova, but to Dadashov Khanlar Gulaga, registered in Mirgurbanli village of Neftchala region.
He didn’t put the budget issues on agenda of board meeting of the municipality he headed and exceeding his office duties violated article 33 of the law on the status of municipalities. He misappropriated 9.600 AZN on the plea of New Year presents for poor children, 1900 AZN on the plea of New Year trees in the resorts areas of municipality residents, 3500 AZN for New Year party, signing an order on December 26, 2007 for allocation of totally 15.000 AZN.
Masimov was arrested and charged with articles 179.3.2, 309.1 and 314.1 of the Criminal Code. The investigative actions are continued for detention of other persons involved in this crime.
