Baku–APA. There are 48 cases currently communicated between Azerbaijan and European Court of Human Rights, Legal Education Society Information Service reported. According to APA, the cases related to the violation of different articles of the European Convention on Human Rights and Fundamental freedoms. 11 complaints are about the violation of Article 3 (ban on torture, inhuman or degrading treatment or punishment), 8 – Article 5 (liberty and security of person), 40 – Article 6 (right to fair and public court hearing), 4 – Article 7 (no one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national or international law at the time when it was committed), 6 – Article 8 (right to respect for private and family life), 15 – Article 9 (freedom of thought, conscience and religion), 11 – Article 9freeodm of expression), 2 – Article 11 (freedom of peaceful assembly and freedom of association), 34 – Article 13 (effective remedy of protection the rights), 37 –Article 14 (rights and freedoms without discrimination), 19 – Article 1 of the Convention’s Protocol 1 (right to security of property), one – Article 2 of Protocol 1 (right to education), one – Article 3 of Protocol 1 (right to free election), one – Article 4 of Protocol 7 (not to be double sentenced and punished).
There are 19 complaints about the violation of Article 3 of Protocol 1 (free election) during the 2005 parliamentary elections. There are also complaints by two Armenian citizens (Arakelyan and Sargsyan).
