Court to pass judgment on servicemen accused of bullying, March 5

Baku. Ramil Mammadli – APA. Baku Military Court held hearing on the case of the soldiers Famil Ganiyev, Javid Yusifov, Adil Abbasov, Rahid Jafarov and Elkhan Almammadov, who committed illegal actions against the soldiers treated in the military hospital of Defense Ministry in Elet. APA reports that Judge Salman Huseynov presided over the process.
The defendants’ lawyers addressed the court. The lawyers asked the court to take into consideration the defendants’ age, personality, clean record, family. The defence wanted the court to apply Articles 62 (assignment of mitigate punishment, than it is provided for the given crime) and 70 (suspended sentence) of the Criminal Code on the defendants. The defendants made final plea. They said they repented for their actions and asked the court to take it into consideration.

The court will announce the judgment on March 5.

According to the indictment, the soldiers faced charges under Article 332.2 (infringement of authorized rules of mutual relation between military men at absence between them of subordination relations, connected with humiliation of honor and advantage of victim or with application of violence against him) and 332.2.3 (the same act committed by group of persons, on preliminary arrangement by group of persons or by organized group) of the Criminal Code. On February 21, 2008, they acted contradicting the regulations and ordered the soldiers treated in Defense Ministry’s hospital in Elet to beat each other. The defendants had planned the act earlier.
At the previous hearing the public prosecutor demanded 4 and a half year imprisonment for Famil Ganiyev and 4 year-imprisonment for Javid Yusifov, Adil Abbasov, Rahid Jafarov and Elkhan Almammadov.
The video showing bullying was released on the Internet, after that criminal case was launched on the fact.
