The ratification of the European Human Rights Convention Protocol 14 has been started, Philippe Boillat, Director General of Human Rights and Legal Affairs of the Council of Europe said at a briefing at the Council of Europe, APA European bureau reports. Boillat said the protocol would allow cases to get to the European Court of Human Rights more quickly and to make the court’s work more effective. The new protocol contains two major reforms: cases that are categorically inadmissible can be processed and dismissed by one judge, as well as the current committee of three; admissibility and merits of cases where there is well established case law can be decided by a three-judge committee, instead of the seven required at present. It opened for signature on May 27, 2009 and its provisions will have the force of law in those member states that sign and ratify it. The protocol needs to be ratified by three countries to become valid. Boillat said if all member countries ratified the protocol or accepted its several provisions it would make 30-percent effective the court’s work even it couldn’t solve all problems.
Protocol 14 bis has been adopted by the ministers for foreign affairs of the 47 member states of the Council of Europe in 119th meeting in Madrid on May 12, 2009. The protocol bis aims to allow the main protocol to use its procedural elements urgently and temporarily.
