Property of drivers not paying fines in time can be confiscated in Azerbaijan

Besides, each driver will receive information via net on violations and punishments applied for this violation. All of these have been considered in the amendments to the law on Traffic, which recently came to force.

The most interesting changes and novelties in the law are related to payment of fines. That is, according to article #85.1 added to the law, the person, who violated rules, must pay fine within 30 days after the decision made. 10% discount is offered to person, who pays the fine within 3 days.

According to amendments, a driver can pay the fine at the site with plastic card via POS-terminal owned by police officer. If it is impossible to pay with card, then a notification is send via the bank.

If a person does not pay fine within 30 days, late payment interest at amount of 2% is added to fine for each day.

If a fined driver does not pay fine within 2 month, a decision is made on impounding of his/her car. Here we speak about not all cars of the driver, but only the car, by which he/she violated rules. So, that car is stopped, taken from driver and the car is taken to the parking. Only when the fined person pays both fine, late payment interest, as well as money for bringing car to the parking and impounding, he/she can take car from here.

If the fined person does not pay the fine within 3 months, that is, after impounding of car, he/she is completely forbidden to drive any car â€“ that is, personâ€™s right to drive a vehicle is limited until the payment.

At the same time, the driverâ€™s work is directed to compulsory execution for provision of payment of fine. During the compulsory execution, if the debtor does not pay the debt, compulsory executive measures are taken in accordance to the Law on Execution.

If the person violating the rule, is not the owner of car, according to the law, another measure is taken against the debtor â€“ the request is directed to the same personâ€™s salary, pension and other incomes.

If he/she has not incomes, the request is directed to debtorâ€™s funds in the third person: â€œThat person has property registered for his parents name and if those are proved with two witnesses, the fine is directed to that propertyâ€. According to experts, this method is more effective.

According to other amendment, any person violating the rules can get information about the administrative fines and their results via internet. Consequently, a driver can enter the number of Drive licence the site and get information. These information will be renewed, permanently.
