European Court announces its resolution on case of â€œMusavatâ€ newspaperâ€™s editor and journalist

Baku. Victoria Dementyeva â€“APA. The European Court of Human Rights notified in writing its Chamber judgment in the case of the editor and journalist for â€œMusavatâ€ newspaper Rovshan Mahmudov and Yashar Agazadeh. APA reported quoting the ECHR website as saying that the complainants applied the court on August 9, 2004. The court concluded that there had been a violation of Article 10 (freedom of expression) of the European Convention on Human Rights concerning the applicantsâ€™ conviction for defamation of a politician and well-known expert on agriculture. â€œThe Court considered that there had been no justification for the imposition of a prison sentence. Such a sanction, by its very nature, had a chilling effect on the exercise of journalistic freedomâ€.
Under Article 41 (just satisfaction) of the Convention, the Court awarded the applicants, jointly, 1,000 euros (EUR) in respect of non-pecuniary damage and EUR 925 for costs and expenses.
