European Court announces its resolution on case of “Musavat” newspaper’s editor and journalist

Baku. Victoria Dementyeva –APA. The European Court of Human Rights notified in writing its Chamber judgment in the case of the editor and journalist for “Musavat” newspaper Rovshan Mahmudov and Yashar Agazadeh. APA reported quoting the ECHR website as saying that the complainants applied the court on August 9, 2004. The court concluded that there had been a violation of Article 10 (freedom of expression) of the European Convention on Human Rights concerning the applicants’ conviction for defamation of a politician and well-known expert on agriculture. “The Court considered that there had been no justification for the imposition of a prison sentence. Such a sanction, by its very nature, had a chilling effect on the exercise of journalistic freedom”.
Under Article 41 (just satisfaction) of the Convention, the Court awarded the applicants, jointly, 1,000 euros (EUR) in respect of non-pecuniary damage and EUR 925 for costs and expenses.
