State Labor Inspection to conduct raids to investigate job conditions in the temperature of above 41 C

But after the amendments made to the Labor Code in May last year, work is to be stopped when the temperature is above 41 C,â€ deputy head of the legal department of Azerbaijan Trade Union Confederation Leyla Ajalova told APA. She says if the temperature is above 41 C then Trade Union Confederation can take extra measures to stop work.
â€œTrade unions have been informed about it. If the temperature is above the limit, if there is trade union in that enterprise, there is no cool condition there, trade union organizations will appeal to the employers. We do not have authority to interfere in the work of the enterprises that do not have trade union organizations,â€ she said.

Leyla Ajalova says if there are trade union organizations in the hot and outdoor work places, these organizations must reach agreement with the employer, stop work and employees must be given breaks. But this break has not been determined by the law. Break depends on the temperature and working regime.

The lawyer said if the offices didnâ€™t accept request of trade unions, the Trade Union Confederation (TUC) could address relevant organizations on that issue. Ajalova said TUC have not been addressed by any office so far.

Ajalova said there were trade unions in many enterprises except foreign companies and private televisions. She added that temperature in the offices doesnâ€™t exceed 41 C.

Chief of the State Labor Inspection of the Ministry of Labor and Social Protection Nabi Shukurlu told APA that the enterprises received letters requesting to organize job conditions during hot weather, to give soft drinks to the employees and to organize breaks in afternoon. He said the State Labor Inspection and trade union officials would conduct raids to investigate job conditions in the offices during the hot weather. â€œJobs under the sun will be stopped temporarily. The enterprises which continue to work refusing requirements in such conditions will be urged to take necessary measuresâ€.
