Mammadov’s lawyer Fuad Aghayev made a speech at the hearing, recalling the resolutions of the European Court of Human Rights and the Council of Europe Committee of Minister on the arrest of Ilgar Mammadov. “All documents demand the immediate release of Ilgar Mammadov,” said the lawyer.
The lawyer further asked the court to uphold the cassation appeal and terminate the criminal case against Mammadov.
Later on, Yagublu’s lawyer Nemat Karimli addressed the hearing, protesting the delay of the process.
Public prosecutor Rasul Abbasov then said that there is no need for termination of criminal proceedings as earlier court instances found them guilty. He said that Shaki Court of Appeal rejected some appeals of defendants and it can be regarded as violation of article #6 of the European Convention on Human Rights. The public prosecutor asked the court to pass a relevant judgment in this regard.
Then the judge announced the judgment. According to the judgment, the cassation appeal was partially upheld. The decision of Shaki Court of Appeal on the case of Ilgar Mammadov and Tofig Yagublu was cancelled and the case was sent to Shaki Court of Appeal for reconsideration.
Ilgar Mammadov and Tofig Yagublu were arrested over Ismayilli events.
Shaki Court of Grave Crimes sentenced to Ilgar Mammadov to 7 years and Tofig Yagublu 5 years in prison. Shaki Court of Appeal rejected the appeal against the judgment.
The cassation appeal covered abolishment of judgments and their release.
