Azerbaijan to grant business visas to digital nomads

Digital nomads will be granted business visas in Azerbaijan, APA reports.

This is reflected in a proposed amendment to the Migration Code discussed at today’s meeting of the Milli Majlis Committee on Economic Policy, Industries and Enterprising.

A digital nomad is a foreigner or stateless person who works remotely in the fields of digital technologies, artificial intelligence technologies, cybersecurity and innovation through information and communication technologies and earns income from foreign sources.

Under the draft amendment, a petition from an inviting party and a document confirming the purpose of the invitation will not be required for business visas issued to digital nomads.

A digital nomad applying for a business visa must submit copies of apostilled or legalized documents confirming that they carry out such activities and have had a stable average monthly income from foreign sources over the past six months amounting to no less than 13 times the minimum monthly wage.

Foreign and stateless digital nomads may be granted temporary and permanent residence permits in the Republic of Azerbaijan. For digital nomads, this may serve as grounds for granting a temporary or permanent residence permit in Azerbaijan if they register with the tax authorities and carry out the specified activities as residents of a technology park.

To obtain a temporary residence permit in Azerbaijan, a digital nomad must submit copies of apostilled or legalized documents confirming that they carry out such activities and have had a stable average monthly income from foreign sources over the past six months amounting to no less than 13 times the minimum monthly wage.

Digital nomads will be granted temporary residence permits in Azerbaijan for the period specified in the applicant’s request, but for no longer than three years. If the relevant grounds remain in place, the permit may be extended each time for a period not exceeding three years.

To obtain or extend a permanent residence permit in Azerbaijan, a foreigner or stateless person must submit copies of apostilled or legalized documents confirming that they carry out digital activities and have had a stable average monthly income from foreign sources over the past six months amounting to no less than 26 times the minimum monthly wage.

Note that when applications by foreigners and stateless persons for permanent residence permits in Azerbaijan are considered, their knowledge of the rights and obligations stipulated by Azerbaijani legislation, as well as their knowledge of the state language, is assessed by a commission consisting of specialists from the relevant executive authorities. This requirement will not apply to digital nomads.

Under a proposed amendment to the Law “On Social Insurance,” digital nomads will be covered by compulsory state social insurance.

If adopted, the law will enter into force on January 1, 2027.
