Azerbaijan to introduce new rules for registration of foreign diplomats and their family members

The registration of foreign diplomats and their family members in Azerbaijan will be regulated under new rules, APA reports.

This is reflected in a proposed amendment to the Migration Code discussed at today’s meeting of the Milli Majlis Committee on Legal Policy and State Building.

Currently, employees of diplomatic missions and consulates of foreign countries operating in the Republic of Azerbaijan, as well as representative offices of international organizations, persons included in administrative and technical staff and their family members, as well as foreigners visiting the Republic of Azerbaijan on a diplomatic mission or, in cases stipulated by international treaties to which the Republic of Azerbaijan is a party, on a special mission, are registered by the relevant executive authority. In this regard, they are issued a relevant identification card, the sample of which is approved by the relevant executive authority. For the purpose of migration registration, the relevant executive authority submits information about these persons to the relevant executive authority within 10 days.

An official visit visa is issued to employees of diplomatic missions and consulates of foreign countries operating in the Republic of Azerbaijan, as well as representative offices of international organizations, persons included in administrative and technical staff and their family members, as well as foreigners and stateless persons visiting the Republic of Azerbaijan on a diplomatic mission or, in cases stipulated by international treaties to which the Republic of Azerbaijan is a party, on a special mission. The period of stay in the country under these visas is determined by the validity period of the issued visa. The extension of the period of temporary stay in the country for employees of diplomatic missions and consulates of foreign countries operating in the Republic of Azerbaijan, as well as representative offices of international organizations, persons included in administrative and technical staff and their family members, as well as foreigners visiting the Republic of Azerbaijan on a special diplomatic mission or, in cases stipulated by international treaties to which the Republic of Azerbaijan is a party, on a special mission, is carried out in accordance with this Code by the relevant executive authority through the issuance of a new visa.

According to the draft, foreign or stateless staff members of diplomatic missions and consulates of foreign states operating in the Republic of Azerbaijan, bodies, divisions and representative offices of international organizations, and their foreign or stateless family members living with them, as well as persons visiting the Republic of Azerbaijan on a diplomatic mission or, in cases stipulated by international treaties to which the Republic of Azerbaijan is a party, on a special mission, will be registered by the relevant executive authority if they temporarily stay in the Republic of Azerbaijan for more than 15 days. When these persons are registered, they will be issued a registration card by the relevant executive authority confirming their status and registration in the Republic of Azerbaijan.

The individual completion and issuance of the registration card will be carried out by the relevant executive authority through the interagency automated information-search system “Entry-Exit and Registration,” and information on foreigners and stateless persons who have been issued registration cards will be transmitted through that system to the Unified Migration Information System. The description, specifications and sample of the registration card for the specified persons, as well as the rules for their registration, will be approved by the relevant executive authority.

The extension of the period of temporary stay of the specified foreigners and stateless persons in the Republic of Azerbaijan will be carried out by the relevant executive authority in accordance with this Code through the issuance of a new visa. Thus, according to the proposed amendment, the list of these persons is further clarified, and a period of stay of more than 15 days in the Republic of Azerbaijan is established for their registration by the relevant executive authority. At the same time, the rules for issuing registration cards to this category of persons during their registration, as well as the procedure for completing and issuing these cards using the existing information-search system and the rules for entering information into the relevant electronic system (Unified Migration Information System), are improved, thereby further expanding the scope of the use of digital services. The draft also establishes a requirement that the description, specifications and sample of the registration card for the above-mentioned persons, as well as the rules for their registration, be approved by the relevant executive authority.

At the same time, the list of persons to whom an entry visa issued for the purpose of an official visit applies is further clarified.
