Patent holders are being granted a new right, APA reports.
This is reflected in the amendment proposed to the Law “On Patents,” which was put up for discussion at today’s session of the Milli Majlis.
According to the draft, the patent holder has exclusive rights to transfer patent-related rights by inheritance or to other persons, as well as to conclude a license agreement for the use of the patent.
The use, offer for use, sale, and import of products that have been lawfully placed into commercial circulation in any country by the patent holder or with the patent holder’s consent will not be considered a violation of the patent holder’s exclusive rights, without prejudice to the provisions of this law, the Eurasian Patent Convention, and the Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention.
The draft was put to a vote and adopted in the third reading.
