Former Ukrainian Deputy Minister facing extradition to Spain alongside Oleg Bakinsky

The trial of Oleg Krapivin, a Ukrainian millionaire known in the criminal world as "Oleg Bakinsky", and Konstantin Kucher, who were arrested in Azerbaijan on charges of hooliganism, continued today at the Baku Serious Crimes Court, APA reports.

Presided over by Judge Elnur Nuriyev, the session included a motion from lawyer Elshad Aliyev to terminate the case due to an ongoing extradition process concerning Kucher in Spain.

The lawyer argued that the charges against Kucher in Spain have no equivalent in Azerbaijani law and that this case is delaying the foreign proceedings.

The public prosecutor stated that this case is not dependent on the other one and that, since Konstantin Kucher committed the crime on the territory of the Republic of Azerbaijan, there is no basis for dismissing this criminal case: “I don’t know what’s happening with that case. I assume that one might depend on this, but this one does not depend on it in any way. Therefore, I propose that the motion to be rejected.”

The motion was not granted.

Later, the examination of documents continued during the hearing.

K. Kucher's lawyer submitted a document to the court, stating that his client had no intent to defraud or act out of greed. He said that the defendant merely owes a debt to the victim.

Oleg Krapivin’s lawyer, Kheyransa Babayeva, filed a motion, stating that her client has serious health issues: “My client must receive treatment due to serious health problems. He previously received medical care in Germany. Currently, he needs appropriate conditions to continue this treatment, which is not possible in the detention facility. I ask you to place him under house arrest.”

The victim’s lawyer requested that the judicial investigation be concluded.

The motion to place Oleg Krapivin under house arrest was not granted.

The hearing will resume on May 2.

Note that "Oleg Bakinsky" was arrested in Baku last year for alleged hooliganism against a Russian citizen. He was charged under Article 221.3 of the Criminal Code (hooliganism committed with the use of weapons or objects used as weapons, accompanied by violence against the victim or destruction/damage of another's property). A pretrial detention measure was imposed against him.

Later, he was also charged under Article 178.4 of the Criminal Code (fraud committed causing particularly large financial damage).

Alongside "Oleg Bakinsky," Konstantin Antonovich Kucher, who served as Ukraine’s Deputy Minister of Defense Industry for Aviation Affairs in 2010-2011, has also been found guilty in the case.

The victims in the case are identified as "Aviazapchast" JSC, "Promyshlennye Postavki Kazakhstan" LLC, and Zakharenkov Valeriy Nikolayevich.
