Azerbaijani gov’t responds to Council of Europe Committee of Ministers decision on Ilgar Mammadov’s case

The government of Azerbaijan has officially responded to the decision of the Council of Europe Committee of Ministers on the case of REAL Movement chairman Ilgar Mammadov.

Erkin Gadirli, one of the leaders of REAL Movement, wrote about this on his Facebook page.

“The government of Azerbaijan responded: In sum, having regard to the absence of the Court's any ruling to secure the applicant's immediate release and the discretion of the High Contracting Party to choose the means necessary to comply with the Court's judgment, the Government considers to implement necessary measures to comply with the Court's judgment in the present case,” wrote Erkin Gadirli.

The Council of Europe Committee of Ministers accepted a resolution on the case of Ilgar Mammadov on October 25. According to the interim Resolution, the committee gave Azerbaijan until 29 November to submit its view in writing. Unless the judgment is implemented in the meantime, a further Interim Resolution sending the case back to the European Court of Human Rights will be presented to the Committee of Ministers on 5 December.

Article 46.4 of the Convention provides the removal of a country which does not fulfill the decisions of the European Court of Human Rights.
