Drivers who inflict less serious and serious injuries during car accidents may be exempt from criminal liability in Azerbaijan.
Member of Parliamentary Committee on legal policy and state building, MP Rafael Jabrayilov told APA that amendments were made to Article 263.1 and 263.1.1 of the Criminal Code in the latest plenary meeting of the parliament and these amendments are to enter into force on November 1.
Jabrayilov noted that according to the amendments, if the person who committed the crime in accordance with the Articles 263.1 and 263.1.1 of the Criminal Code reconciles with the victim and fully compensates for the damage caused, the person will be exempt from criminal liability.
Articles 263.1 and 263.1-1 impose penalties of 2 years’ and 3 years’ imprisonment in addition to other alternative penalties. Drivers engaged in acts described in these articles will be able to gain exemption from conviction, which has heavy legal consequences.
The MP said that offences relating to the car accidents prescribed in Article 263 of the Criminal Code are categorized as crimes committed due to carelessness:
"That is when the driver did not intend to cause the accident. However, he did not see the accident was going to happen but he should have. The victim’s stance and the compensation of the loss suffered are highly important when investigating crimes committed due to recklessness, both legally and morally,” he said.
