One of the amendments made has to do with the question of whether an underage child should stay with his/her mother or father after divorcement.
According to the new amendment, court now has to decide upon the issue of giving the child to the rightful parent while the child had been staying with the other parent.
According to another proposed amendment, new amount of the alimony shall be calculated or person shall be exempted from payment of alimony from the date of court resolution’s entry into force.
The other amendment envisages that relevant executive authority has to carry out the state registration of divorcement after receiving extract of effective court resolution.
A person receiving the certificate of divorce may enter into a new marriage.
The draft law was recommended to the upcoming plenary session of Azerbaijan’s parliament.
