Court starts hearing on claim for recognition of Telman Ismailov bankrupt

Moscow. Farid Akberov – APA. The Moscow arbitration court decided to collect nearly 213 million dollars from the structures controlled by the former owner of Cherkizovsky market Telman Ismailov, RIA Novosti reported.

The decision was made at the suit of Bank of Moscow entering into group VTB, "KBF AST" AST from the group.

The Bank has demanded through arbitration to settle the debt under the credit agreement dated September 28, 2012 with the borrower "ruslayn 2000", the guarantor of the loan was "KBF AST". This parallel structure tried to contest the loan agreement due to its kabelnet. However, the court dismissed the claim.

“KBF AST” LLC has filed a claim against “Bank of Moscow” base on the fact that the credit agreement is fake. Telman Ismailov’s representative said in court that the credit agreement was free for AST group and that the executor could not fulfill the terms of the agreement.

The court rejected the claim.

According to Telman’s representative, the person whose rights he defends is the voucher for the credit. However, the businessman’s attorney has failed to present to court the agreement on Telman being a voucher for the credit. As a result, the court has denied the claim of involving Telman Ismailov in the case of “Bank of Moscow” as a third person.

The Bank of Moscow has submitted to arbitration court the claim about recognition by the bankrupt former owner of the Cherkizovsky market, the founder of the group "AST" Telman Ismailov, said the Russian Kommersant newspaper.

As they say in a lawsuit filed on 1 October in the Moscow arbitration court from September 2012 to February 2014, the Bank has provided three loans totaling more than 230 million dollars of open company "ruslayn 2000" and Tropicano Dutch Finance B. V. Both companies, according to Bank of Moscow, were associated with AST and its beneficiary Telman Ismailov gave personal surety about the repayment of the loan within the deadline.

Neither the interest nor the principal amount, as follows from the claim, were not paid. As a result the total debt of Ismailov as guarantor subject to all penalties and outstanding interest by October 1 reached 286,4 million dollars. The Bank of Moscow decided that since Ismailov "for a long time fails to perform a monetary obligation", he is insolvent. In this regard, the Bank's lawyers asked the arbitration recognize Ismailov and untenable "to impose the procedure of restructuring of debts of a citizen".
