Azerbaijan to deprive prosecuting agencies of carrying out preliminary investigation on obstruction of journalists’ lawful activities

According to an amendment proposed to the article #215 of the Code of Criminal Procedure, the number of investigative activities, which are being carried out by prosecutor’s offices, is being reduced, the Azerbaijani Parliament told APA.

So, prosecuting agencies will not carry out a preliminary investigation on the Criminal Code’s article #163 (obstruction of the lawful activities of a journalist) and 164 (Infringement of labor rights of a pregnant woman or woman who has children at age of three).

Currently, prosecuting agencies are conducting investigations on the articles #100-113, 120-125, 126.3, 135-138, 145, 146, 154-164, 165.2, 165-2, 165-3, 166.2, 167-168, 169-1, 179, 189-1, 190, 191, 193-1, 195, 195-1, 202-203-1, 208, 210-212, 222, 223, 262, 268, 286-288, 290-302, 304, 307-315, 316-2.1, 317, 317-1.2, 318-1, 321 and 323.

One more amendment is expected to be made to the prosecuting agencies’ authorities. If the criminal case is launched by prosecutor’s office on the article #162-1 (attracting employees to work (services) before labor contract comes into force), prosecutor’s offices can carry out preliminary investigation on that fact.

The draft law will be discussed at the Azerbaijani Parliament on May 2.
